General Terms and Conditions (GTC) – Leypold Gastronomie KG

1. Scope

These terms and conditions apply to all services provided by Leypold Gastronomie KG, in particular for
– Room and apartment rentals
– gastronomic services
– Events and catering
– Reservations and online bookings.

Any differing terms and conditions are only valid if they have been confirmed in writing.

2. Hotel and apartment rentals

2.1 Conclusion of contract

A binding accommodation contract is concluded upon written, telephone or electronic booking confirmation.

2.2 Arrival & Departure

Check-in: from 3:00 PM
Check-out: until 10:00 AM
Late arrival is possible by prior arrangement.

2.3 Services

Rooms and apartments are offered with or without breakfast – depending on the rate booked.
Pets are allowed upon request.

2.4 Cancellation policy

Unless otherwise agreed upon at the time of booking, the following rules apply:

– up to 7 days before arrival: free of charge
– from 7 days before arrival or no-show: 100% of the booked arrangement

2.5 Down payment

Depending on the rate, a deposit or credit card guarantee may be required. If this is not received on time, the reservation may be cancelled.

2.6 Liability & Damages

The guest is liable for any damage to the room or apartment.
No liability is assumed for valuables unless there is gross negligence on the part of the company.

3. Events & Catering

3.1 Conclusion of contract

By placing an order, the organizer accepts these terms and conditions.

3.2 Cancellation policy for events

– up to 2 days before the event: free of charge
– within 2 days: 50% of the agreed arrangement

3.3 Number of people

The guaranteed number of people must be announced 48 hours before the start.
This figure serves as the minimum basis for invoicing.
Additional people will be billed according to their actual attendance.

3.4 Food & Hygiene

Due to legal regulations, food may only be left unrefrigerated for a maximum of 3 hours.
After handover, the organizer assumes responsibility for compliance with food hygiene regulations.

3.5 Decoration

Decorations must comply with fire safety regulations.
The organizer bears the costs for assembly, disassembly or damages.

3.6 Music & Permits

The organizer is obliged to handle the necessary AKM notifications and entertainment taxes himself.

4. Prices, Payment Terms

All prices are in euros and include taxes and duties.
Invoices are due within 10 days without deduction.
In case of late payment, statutory default interest will be charged.

5. Liability

The guest or organizer is liable for damages caused by him, his guests or commissioned third parties.
Leypold Gastronomie KG is only liable for its own gross negligence.
The company accepts no liability for items brought onto the premises in case of loss or damage caused by third parties.

6. Withdrawal / Termination by Leypold Gastronomie KG

A withdrawal is possible if
– Down payments are not made on time
– Safety or hygiene guidelines are violated
– the reputation, safety, or operational process is at risk
– force majeure exists.

The contractual partner has no right to claim damages.

7. Data protection

Personal data is processed exclusively for the purpose of fulfilling the contract.
Our privacy policy applies in accordance with the GDPR.

8. Jurisdiction & Choice of Law

Austrian law applies exclusively.
The place of jurisdiction is Murau, Austria.

9. Severability Clause

Should individual provisions of these terms and conditions be invalid, the remaining provisions shall remain unaffected.
The ineffective provision will be replaced by one that is as economically equivalent as possible.
